Pursuant to Art. 13 of Legislative Decree no. 196 dated 30th June 2003 ("The Privacy Code"), of Art. 13 of European Regulation No. 679 of 2016 (the "Privacy Regulations"), Elica S.p.A. would like to inform you and all users and/or visitors to the site people.elica.com ("Users" and the "Site" respectively) about the use of personal data, log files and cookies collected via the Site.

Information automatically collected by the Site - Cookies

a) Information collected automatically

As is the case with all websites, our site also uses log files in which information collected automatically is stored during your visits. In fact, the information systems and software procedures which perform the functions of the website automatically acquire, during their operation, some information, the transmission of which is implicit in the use of Internet communication protocols. The following information is collected:

  • Internet Protocol (IP) address or the domain name of the device you are using;
  • type of browser and parameters of the device used to connect to the website;
  • the URI (Uniform Resource Identifier) addresses of the resources requested or the method used to submit the request to the server;
  • the name of the Internet service provider (ISP);
  • date and time of visit;
  • the user's source (referral) and exit web page;
  • the number of any clicks;
  • the size of the file obtained in response;
  • the numerical code indicating the status of the response given by the server (success, error, etc.);
  • other parameters related to your device's operating system and digital environment.

This information is handled automatically and is collected only in aggregate form in order to ensure the correct functioning of the site.

b) Cookies

Cookies are used on the site. Cookies are text files stored on digital support that allow a few parameters and data to be recorded, communicated to the digital system through the browser you use. Such instruments allow for an analysis of your habits when using the site, for different purposes: carrying out informational authentication, session monitoring, storing of information regarding specific configurations of users that access the server, storing of favourites, etc. Cookies are classified as follows:

  • Technical cookies: used to carry out browsing or to provide a service you have requested. Without the use of these cookies, some operations could not be fulfilled or would be more complex and/or less secure.
  • Profiling cookies: these are used to track your browsing and to create profiles on your tastes, habits, choices, etc. This way, advertising messages can be sent to your device in line with the preferences you have already manifested in previous online browsing sessions.

Your consent is not required for the installation of technical cookies. For the installation of profiling cookies, your consent is required: if you do not want your device to receive and store the profiling cookies, you can change the security settings on your browser. Indeed, by changing the settings of the browser used you can decide whether to delete and/or avoid the installation of cookies all together on the device you are using.
However, it should be noted that if you deactivate profiling cookies you will not be able to use some functions of the site. Through the use of the website, the use of cookies is considered to be accepted, as well as your consent to data processing by Third Parties.

Personal data that you give us using the side: purposes of processing.

We need your data in order to allow you, via the use of the site, to:
update, via e-mail, regarding all out promotional and marketing initiatives, including direct marketing, and for example information relating to the latest collections, events and publicity campaigns organised by the Controller (the "Newsletter");
Your personal data is processed for the following purposes:

  • fulfil legal obligations;
  • carry out technical management of the website;
  • provide the Newsletter service with the sending of promotions, offers and reserved discounts (following optional, free and specific consent);

The data processing for the above purposes will be carried out in accordance with the Privacy Code, the Privacy Regulation and all the specific standards in the sector including the provisions of the “Rules of the Protection Authority for loyalty programmes” of 24 February 2005 and the “Guidelines on personal data processing for on-line profiling” of 19 March 2015. According to the "Guidelines for Promotional Activities and Prevention of Spam" dated 4th July 2013, you should be aware that the consent given by you for the sending of marking by automated means will also be extended to traditional contact methods.
The data supplied by you will mainly be processed by electronic means under the authority of the processing controller, by subjects specifically charged with doing so, authorised and trained to process data pursuant to Art. 30 of the Privacy Code and Articles 28 and 29 of GDPR. We would like to inform you that suitable safety measures under Articles 5 and 32 of GDPR have been observed to prevent the loss, illicit or incorrect use and unauthorised accessing of your data.

Obligatory or Optional nature of consent for the supply of data, the consequences of refusal and legal basis for processing

Please be aware that for the purposes indicated in points (i), (ii) of Art. 3 above, the supply of your personal data is required as without it you would not be able to use the services of the website.
However, the supply of your personal data is optional for the purposes of point (iii) of Art. 3 above. Failure to provide the data for the purposes indicated above will prevent us from providing you with the Newsletter. On this basis, you are free to choose whether to give consent also for such purposes, without which you will not be able to access site services.
Remember that in any case and at any time you can request that the controller deletes your data by simply sending your request, in no particularly formal manner, to the contract details in Art. 1 above.
With regards to the purposes in points (i) and (ii) of Art. 3 above, the legal basis for processing is for carrying out the services supplied via the website and requested by you (pursuant to Art. 6 comma 1 letter B of GDPR and Art. 24 comma 1 letter b of the Privacy Code); whereas with regards to the purposes of point (iii) in Art. 3 above, the legal basis for processing is your freely expressed consent (pursuant to Art. 6 comma 1 letter a of GDPR and Art. 23 of the Privacy Code).

With whom we may share your data

Your data may be sent to, within the EU, and within the boundaries of the Privacy Code and GDPR, the following subjects:
(i) to financial administrations and/or public authorities, where required to do so by law or on their request;
(iii) to third party establishments, subjects and companies that the Data Controller employs for carrying out related, instrumental or consequential activities of the Service Site - including cloud computing storage services, sending newsletters;

Your Rights

Remember that at any time you can exercise your rights under Art. 7 of the Privacy Code and under articles 15, 16, 17, 18, 20 and 21 of GDPR, by sending a written request to the contact details of the Data Controller and/or DPO detailed in Art. 1 and in so doing obtain:

  • confirmation of whether or not your personal data exists with indication of the related origin, verify their correctness or request their update, correction or integration;
  • access, correction, deletion of the data or limitation of the processing;
  • cancellation, transformation to anonymous form or blocking of any data processed in violation of the law. You may also oppose to the processing of the data that concerns you.

With reference to the Newsletter, we hereby point out that your right to request termination of the processing carried out through automated contact methods also extends to traditional methods. Furthermore, you have the right to exercise this right only in part, that is by requesting the suspension for example of the receipt of promotional communication carried out by one or more of the contact methods for which you have given consent.

Duration of Processing

Notwithstanding legal requirements, personal data will be kept for a set period, as per the criteria founded on the nature of the services supplied. It should be noted that the data kept for marketing purposes (specifically related to the Newsletter service) will be kept and usable until such time as the interested party does not request to be removed (or excluded) from the service, by exercising the rights provided for by applicable regulations.

Safety measures

Via the site, your data is processed in compliance with the applicable laws and by using suitable safety measures in respect of applicable legislation, also pursuant to Articles 5 and 32 of GDPR. In this regard, we further confirm the adoption of suitable safety measures to prevent the unauthorised access to or the unauthorised theft, dissemination, modification or destruction of your data.

The Data Controller reserves the right to make changes to this Privacy information. In this case, you will be promptly informed thereof when you use the website again.
